Academy named as pedicle screw defendant

The Academy has been named as a defendant in a number of recently-filed lawsuits regarding pedicle screw spinal fixation devices. The suits, filed to date in New York, Ohio, Virginia, and Minnesota, allege that the Academy, the North American Spine Society (NASS), the Scoliosis Research Society (SRS), and others were "Promotional Centers" for pedicle screws, and that the associations aided spinal implant manufacturers in promoting the use of the screws by, among other things, the societies'; educational seminars and workshops. Of the 15 counts in the suits, three specifically involve the associations as "Promotional Centers": (1) illegal marketing and promotional activities; (2) intentional or negligent infliction of emotional distress; and (3) fraud on the marketplace. The Academy, NASS, and the SRS will vigorously defend these suits.
