AAOS Report - July, 2005

Here’s an update on AAOS Expert Witness Affirmation Statement

One year ago, AAOS distributed Expert Witness Affirmation Statements. Since then, more than 6,400 fellows and members have signed the voluntary acknowledgement of their obligations when providing orthopaedic expert witness testimony. Signed Expert Witness Affirmation Statements continue to be submitted daily. Many orthopaedists have asked how the affirmation statements are used and whether they can verify if another physician has signed one.

Signed Expert Witness Affirmation Statements are maintained in the Professional Compliance/Expert Witness program office. These signed statements are made available, upon written request, to both the defense and plaintiff counsel. Typically, a dozen requests from law firms are honored each month. In addition, orthopaedists may request either signed copies or verification that someone has signed the Expert Witness Affirmation Statement. In the past year, the Professional Compliance/Expert Witness Program has honored nearly 250 requests from law firms and orthopaedic surgeons.

The online Expert Witness Affirmation Statement database may be accessed through the members-only section of the Expert Witness Program at www.aaos.org Click on the link “Search for members who have signed statement.” You can access information by name or location. Fellows and members who have not signed the Expert Witness Affirmation Statement, but wish to do so, may download a copy of the statement from the members-only section of the site and fax the signed statement to (847) 823-8028.
