Academy joins appeal in PATH lawsuit
The Academy, in litigation coordinated by the Association of American Medical Colleges and American Medical Association, recently filed an appeal to the decision of the U.S. District Court for Central District of California that grants the U.S. government's motion to dismiss the Physicians at Teaching Hospitals (PATH) lawsuit. The lawsuit includes many other medical specialty societies representing medical schools, teaching hospitals and faculty physicians that are seeking an end to the PATH audit program as it is currently being conducted by the Office of the Inspector General. On April 27, Judge Carlos Moreno ruled to accept the government's motion to dismiss the case due to issues of timing and jurisdiction, not the core arguments of the litigation. The appeal continues to assert that the Medicare audits of teaching hospitals are in need of significant reform.
